Terms of Use
These Terms of Use (the “Terms”) form a legal agreement between you and Emmanuel Tassone (“Postly,” “we,” “us,” or “our”) governing your use of the Postly mobile application and related services (the “Service”). Postly helps creators and businesses generate, schedule, and publish social media content with AI.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
- You must be at least 13 years old (or the minimum age required in your country) to use the Service.
- You are responsible for keeping your account credentials confidential and for all activity under your account.
- You must provide accurate information when creating your account and profile.
2. Subscriptions and billing
Postly offers auto-renewable subscriptions (for example Starter, Standard, and Pro, on monthly or yearly periods). The subscription title, duration, and exact price are shown on the purchase screen before you confirm your purchase.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Your account is charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.
- You can manage or cancel your subscription at any time in your App Store account settings. Cancellation takes effect at the end of the current billing period.
- Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription.
- Prices may change with notice; continued use after a price change constitutes acceptance of the new price.
3. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or misleading content
- Violate the terms or policies of the social platforms you connect (for example LinkedIn, X/Twitter, Instagram, TikTok, Bluesky)
- Infringe intellectual property, privacy, or publicity rights of others
- Attempt to reverse engineer, disrupt, or abuse the Service or its infrastructure
- Resell or share your account access with third parties
You are solely responsible for the content you generate and publish through the Service, including reviewing AI-generated drafts before publishing.
4. AI-generated content
The Service uses AI providers (currently Google Gemini / Google AI) to generate drafts, images, and related content. AI output may be inaccurate or inappropriate; you are responsible for reviewing and approving content before it is published. You retain ownership of the content you create, subject to the rights of any third-party materials you include.
5. Intellectual property
The Service, including its design, branding, and software, is owned by Postly and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose while your account is active.
6. Third-party services
The Service relies on third parties such as Apple, Google, PostPeer, and the social networks you connect. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, including changes to their APIs or availability.
7. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate.
8. Limitation of liability
To the maximum extent permitted by law, Postly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for violations of these Terms or to protect the Service and other users. Upon termination, your right to use the Service ends; subscription fees already paid are non-refundable except as required by law or Apple’s policies.
10. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the “Last updated” date. If changes are material, we may provide additional notice in the app or by email. Continued use of the Service after changes take effect constitutes acceptance.
